mortgage repossession court case

Postby nicbrahms » Thu Jun 28, 2012 9:54 pm

Okay so I appeared in court for my brother who has his bank, santander chasing possession. I queried the contract and asked for the original and also quizzed santander's solicitor, it astounded me as to how little these people know about what is going on.

Anyway I managed to get the possession delayed.

So long story short, the only way we can get a prima facie case and create history is for one of us to sue our mortgage company.

So I have asked my mortgage company for the original contract as of yet nothing. I am going to file at county court and sue them for the original value of my mortgage plus 4 x what I have paid them thus far.

When I get to court, due to the large amount I am suing for I will ask for and should be given a trial by jury, yes thats right people even in county court a jury trial is held.

Once I present my case in front of a jury, all of which will have mortgages, I am sure they will see the benefit to them and the country of them finding in my favour.

I have read until my eyes are bleeding, I pretty much know everything and so should beable to hold my own.

This as far as I can see is the only way to get a decision in our favour as judges won't do it. Once we get one case in this country it should open the doors for everyone else. And i predict all mortgages forgiven in the uk by the end of this year.

We all know the entire system is going to collapse at anytime under its own avarice, its time we bandied together like they did in iceland and demanded change.

Anyway I will be posting on here on what I am doing, with regards to mortgages etc.

Also anything else of interest.

I and my family have been council tax free for 5 months on 6 properties. We don't have tv licences, we do not pay any parking fines, and we are now going income tax and vat free. Also all loans and debts payments have been stopped for over a month and we are quizzing everything with the people chasing for money.

Currently I have an arrest warrant out for me for an unpaid fine from three years ago, which I appealed then and heard nothing about. However, the council sent it through another town's magistrates court and are now chasing me for it. I did the usual, declared my sovereignty, common law rights and stated no contract, also enclosed a fee schedule for their perusal. They dropped the arrest warrant and asked me to appear in court to make representations. I billed them £2250 for my attendance at court and made it conditional on them paying me first. They did not, I did not go. Simples.

So I should be getting a letter anytime saying arrest warrant reissued, I will notify them of my fees again for arrest, and being made to appear in court, and also let them know that any action they take against me against my will, will be construed as common law assault and kidnap etc. And I will sue them as such.

Oh my God, how much fun am I having? Life is frickin awesome and I am free from fear of authority figures and will for everyone to be too.

Continue the good fight people because it will pay off, I know it. And remember anything or anyone that makes you feel fear or oppression is not right, don't stand for it on any level.

We have a God given right to live, in peace, abundance and free of fear.

So is it possible to move the court to notice burden of proof on a previously un-announced point?

e.g ask for proof of contract even if santander have not had their claim challenged in such a way previously.

I have a court date on the 23 july for arrears on my morgage which. Is with halifax thre solicitors are drysdenfairfax .i was thinking off paying 20 a week over the counter to establish agreement and keep the reciept as proof of agreement then challenge them to make there paper work available and try some morgage techniques with these guys which I have seen on this site

Also can anyone tell me what 70000 morgage outstanding not suitable for redemption means
I am not scared jus need to get organised

Halifax legal team rang me about a hour ago I asked there name and position and told them that I would only respond to them in writing which rhey agreed
Thanks boo
Anythouhts and advice or ideas would b appreciated

sounds like the official offer concept, it works for different things.

I did something like this prior to starting here with the 3 letter route, not for a mortgage but and started receiving invoices for £5 a month, recently showed the letter to a friend and they concluded that it was technically an official offer.

look it up in the forum cos it might help.

perhaps do the official offer and they may throw the case out for now.

This official offer is where you offer say 20 quid on your mortgage payment and they must accept but if they do not accept your offer you must continue to offer that amount or whatever amount you offer, by doing so you are showing intent on paying your mortgage instead of not paying at all.

What i would like to know is can we write OFFER OF £XXX and not use the words OFFICIAL?

remember you can just pay at the counter the amount you want to pay in, and thats it the amount and offer has been accepted immediately, no complications.
theres a letter or small note that can go along with a copy of the receipt that the amount was paid in etc.to whoever you're dealing with.
