Notice of Attendance by Bailiffs

This is the first time I have posted on this site so would really appreciate some help/advice.

Basically it all stemmed from an unpaid parking fine for not parking wholly within a bay. I turned down an invitation to Court in February & subsequently the amount I supposedly owe has increased to £400+.

I've had several letters from Philips Specialist Bailiffs threatening to attend/force entry/clamp my car etc.

I sent by Recorded Delivery a notice removing their implied right of access & they responded with another letter trying to scare me & baffle me with Section this & Section that.

Yesterday I came home from work to find a hand delivered Notice of Attendance, so they have obviously ignored my laminated notice on the gate also removing their implied right of access. Apparently if I don't pay immediately, they will turn up again unannounced.

What would be my next step please anybody?

does it have a name on it? if so start the collection process
DEMAND FOR PAYMENT NOTICE
NOTICE OF DISHONOUR AND OPPERTUNITY TO CURE
DEFAULT NOTICE
COURT for trespass

they can not force entry, scare tacticks well do the above if you have a name but follow it through and have the s#it pay £5,000.00
he will never ignore one again then once he has coughed up 5k

I had the same thing with this company.

never got anything out of me.

Then got another summons both were for driving offence, sent summons back by post signed guilty, was rewarded with £200 fine, dint pay it, gone to court bailiffs, have not heard a thing since it went to bailiffs begining of march.

All mag court bailiffs work together, i am 95% sure there is only 4 companys that collect on behalf of the mag courts, and phillips is 1 of them.

All mag court bailiffs work together, i am 95% sure there is only 4 companys that collect on behalf of the mag courts, and phillips is 1 of them



so basically you are saying that there are no court bailiffs and they're just private companies ... all of them?

Not 100% sure if this is true but i did read somewhere that there are only 4 companies that collect on behalf of the magistrate.
Going on my experiance with court fines and bailiffs, they are not chasing me cos they know what will happen. I beat 1 of them companies before and also have an outstanding court fine that went to bailiffs and i aint heard anything from them. To me they know what will happen if they come after me.

well if thats is the case re magistrates, bill thornton says that magistrates only make proposals in their orders, they don't actually judge anything.

If you are convicted in the Magistrates' Courts, you would receive a financial penalty which is payable to the Magistrates Court and if this remains unpaid, a Distress Warrant can be issued and passed by the courts to any one of the 4 bailiff companies under Contract by HMCS to enforce these warrants. The companies are Marston Group, Philips Collection Services , Swift Credit Services and Excel Enforcement Ltd.

Swift and Excel enforce Distress Warrant issued by Magistrates Courts in Wales.

maybe but if it’s for council tax or parking tickets any warrant is totally fraudulent and unenforceable if your prepared to stand up for your self

Do you mean with reference to contracts rights of third parties Act.
