Reply from wescott 1st letter

Postby slik1999 » Tue Jun 12, 2012 10:31 am

Hi all,

I'm now dealing with Wescot and have recieved the following reply (attached) to my 1st letter.

Is it a new tactic? Should I just send 2nd letter after 10 days of 1st or wait for them to write back again?

Thanks in advance.

no matter what they send keep going with the 3 letter process as they can never give you what you ask for

Hi there,

I have just received the same letter from them - I have sent them 3 letters.

my question is - if after 4 weeks, I haven't had another letter from them, can I still send an estoppel, or is this a crafty way of them trying to nullify an estoppel, ie: are we (legally) supposed to give them time to investigate, as they have requested?

Grateful for any thoughts.

PS Sorry to butt in on your post slik1999 but our letter is exactly the same as yours !!

They can't stop the estoppel or slow it down as far as I believe unless their reply constitutes full provision of every verification/proof and what have you that we asked for. If their reply doesn't constiute full provision of the aforementioned, it is as if they never sent anything in the first place and you don't have to restart the countdown to 30 days all over again. Am I right?

That sucks then, so let me get this straight if I'm not right then that means that regardless of what shit they send in-between the 3rd letter and the estoppel, even if it doesn't constitute everything that you asked for (and it's clearly nothing more than stalling tactics) you have to restart the 30 day countdown?
Well if that's true all they have to do to stop you from estopping them is send whatever silly meaningless letter a few days before the 30 days is up and they would have just bought themselves another 30 days and they could just keep doing this forever and never allow you to estopp them.

So then the tactic to dissuade them from keep doing that is to send them a bill for every time they make you restart the countdown whithout giving you proper proof and when it gets to a ridiculous amount... it won't matter whether you can estopp them or not anymore.
And just to be clear if lets say they send you a letter in between your 1st letter and your 2nd do you have to restart the 10 day countdown as well before you can send your 2nd letter?

no as they never give you what you ask for so stright 10 days regardless
sometimes just ignore the odd letter and you might get a 30 day gap then
