Thanks GANGSHIELD. I've done all that but can't seem to find their head of legal affairs (or anyone else). I've asked them on the phone too but they aren't willing to give me any information.

Just a wee update. Received the usual CC Statement from MBNA requesting payment (last months and this months) + £12 charges. Looks like I will be dropping them a Bill then. They also included the following text in the statement:-

"Failing to make your minimum payment can mean that you have broken the terms of this credit agreement and could result in us taking legal action against you. It could lead to your having to pay additional costs and make it more difficult for you to obtain credit in the future."

That doesnt sound very threatening to me. The "agreement" is already unenforceable (by their own admission) and they were in breach anyway because the letter that was received telling me it was unforceable arrived after the 14 day period elapsed. That was one of the reasons why I served notices upon them because they were clearly fecking about. Is it worth following up with a letter or shall I just Bill them and leave it at that?

Gonna just Bill them. Just a quick query on the Bill. Is the Bill from the fictitious person or the human being (common law name) and should the Bill be hand signed?
