Well MBNA are doing everything they can to avoid an Estoppel being served on them. I received a letter from them earlier in the week reminding my person that monies are outstanding. I received a phone call yesterday from them which lasted around 45 seconds as they hung up when they realised they couldnt confirm who they were talking to on the phone and I certainly wasnt going to volunteer anything and this morning my person receieved a default notice. I feel another Bill comming on I think. :) All I can say is this. They aint getting a bean from me unless they are prepared to address the notices as served. If they don't like it well thats their problem init!

Hmmm...been sitting here thinking about tacit agreement with MBNA. I am wondering if I have accidentally broken the agreement by sending them a letter returning a statement they issued. I wrote the letter between sending Notices 2 & 3 and it was delivered to MBNA prior to the 10 day period of reply elapsing with Notice 3 thus tacit was not in affect at that point. Wondering if I should resend all the Notices again as a result though incase I have made a boob!!. What does the panel think?

Start again go for it, stick to the time table, do not write to them other than the letters! :!:

Bollocks! I knew it :(. I have not used the standard templates available on the website. I have used part of the content from the letters though along with input from others sources to create what I feel are fairly beefy Notices. I have just realised I have used the word "disputed" on the 1st and 2nd Notice not realising that this could give ground to a court case! I just "fell over" this concept looking through some of the threads in the last hour or so. I am seriously thinking of binning the current Notices and just using the letters from the main website instead which is probably what I should have done in the first place. Bugger!!

Use the 3 letters on this system by starting again - no problem, ignore previous mistakes.

Just a couple of quick question on the 1st Notice template available from the main website:

"2. Verification of your claim against me (a sworn affidavit or a hand signed invoice in accordance with Bills of Exchange Act (1882) );"

Should the above be : 2. Verification of your claim against me (a sworn affidavit or a hand signed Bill in accordance with Bills of Exchange Act (1882) );

and

"Yours sincerely
By: < Your Signature >
By: Sovereign ©Joe-John: Doe; Authorised Representative"

Does the word "Sovereign" have to be on the notice??
