ok so letter 2 went in the post to MBNA today , I had decided before letter1 that I was only giving them 7 days between letters , Had no response to letter 1 yet,so hopefully they stay silent , it makes my job easier :lol: :lol: :lol:

received a letter today from MBNA informing me they had passed the debt to their in-house collections MBNA Ireland Recoveries , its the same letter I got 4 weeks ago off them , so as it happens i was getting letter 3 ready to go in the post tomorrow , so thats it I got them in Tacit then, and I have no doubt they will be racking up the fee's for all the future infringements of copyright etc...i'll keep you all posted ,
p.s I'll post their letter when I get this scanner fixed

i havent heard a thing from them since i sent the 3rd letter not even a phone call :D

well see if you can get the Estoppel away to them when the time is right, they should be really in a mess with the 100 job losses announced for their collections dept here in Ireland , :lol: :lol: :lol: :lol:

just got a letter from mbna now,it gos like this

your credit agreement has been terminated
as detailed in our previous correspondence,we are writing to advise that your mnba credit agreement has being terminated.
please note you are still required to repay your debt of XXXXXXXXXXX

you will no longer receive monthly statements and we have registered a default at the credit reference agencies.this cannot be cancelled or reversed and will stay on your file for the next 6 years.This may impact your ability to obtain credit in the future

what recovery action may we take?
there are various options that we will consider,namely

sale of debt-legally selling your debt and transferring the rights to collection of the outstanding balance to a debt collection agent

placement of debt-placing the debt with an agent to collect the full debt on our behalf

you will be kept informedof any further action

what if i am currently making payments each month?
please continue to make these payments.we may decide to sell your debt,but if we dowe will make sure the details of your financial circumstances and recent payments are passed to the company that buys your debt

can i prevent recovery action?
if you are in a position to pay the full debt or make a reasonable offer in settlement of this matter,we would like to discuss this with you.please contact us

well as you have already sent them the 3 rd letter, I think your next step is to issue a bill for the copyright infringements and for breaking your tacit agreement,that way you have a counter claim against MBNA , then wait and see which DCA contacts you and start the letter process with them, and keep track of the 30 days so you can send the estoppel to MBNA ,

front page, you will have used the bank letters, as you were dealing with bank now its a debt collector so use debt letters
