Any success with Barclays overdraft demand top pay

Hi all,

very new to this whole thing but none the less frustrated with the whole banking system. I have received a termination notice and Demand to pay an overdraft (£390) from an account I haven't used in years.

My contact details have been the same throughout my life with the bank and rather than contact me in a reasonable manner to find out the circumstances, the have written a highly threatening letter demanding that I pay back the overdraft 'immediately with interest' or they will a) hand over my details to a debt collection firm and b) register details of the account with credit reference agencies.

I have fallen on hard times, and can't afford to pay the overdraft. If they had contacted my in a polite, reasonable way I would have maybe spoken with them to arrange something I could afford. But the fact that they have taken this unnecessary, aggressive and threatening stance makes me inclined to use the three letter process I have read about.

Oh and to rub salt into my wounds, they are charging me daily interest until it is paid which will conveniently take me into an unplanned overdraft that will incur more fees. Can they really do this.....it really beggars belief!!!!!!

Would the three letter process work for overdrafts (sorry if this is covered elsewhere by the way) and or Barclays Bank.

Help needed please........thank you in advance guys.

yes use the bank letters then when they pass it on to a debt collector use the debt collector letters

Thank you. Am I right in thinking that when using the 3 lettter process I will be bringing their demand into dispute? From what I have read, this will but a halt on any proceedings until the matters is resolved. Is that correct.

Also, my letter from them says they have terminated the agreement. As nother poster may have mentioned, how can they force me to pay something that falls under an agreement they have terminated!!! Can;t I just tell them to do one! Can I add a similar statement to letter 1, or should I just stick with the process?

Thank you so much....not used to this and think it is time I took a stand!

no dispute just asking them to show what evidence they have that you owe anything when they cant do this then there is nothing for a court to rule over there for no need for court

you can do anything you want, as for what to do that choice is yours

Hi all,

I got a response from a paralegal from RBB Litigation, Barclays Bank PLC. I have seen the same response on this site before (standard template it would seem)...."The process to which you refer has no basis in English Law...etc, etc, asking for £1 to get hold of the alleged "executed agreement". They didn't provide any of the info requested in letter 1 and referred to me as "Mr', which I explicitly told them not to.....! How insulting!!

I am a little confused and feel dumb for asking...but I don't know who I should send the 2nd letter to. Should I respond to the letter from the paralegal? Or just send letter 2 to the same people I sent the 1st letter to and ignore the paralegal letter completely.

Finding the process a little scary, but strangely satisfying!!

Please help...

Just a quick update.

It has been two months since I sent the last letter and then estoppel. I haven't heard the faintest thing.....nothing! Is it too early to claim a result? Prior to the letters, I was getting calls, demands, you name it!!

Thanks for the information Ceylon, awesome. I feel as if I have woken up!!!

If nothing else, your site and information has enabled me to find a strength I didn't know I had.

Before I knew about your site, I would allow myself to be beaten down by the fear and harassment these low-lifes try and hand out.

I have the upper hand now and truly believe that the only power anyone has over me....is the power I am prepare to give them. :D
