Letter from Natwest..Not part of uk consumer credit law

Postby dannypike » Sun May 06, 2012 2:30 pm

Hi Peeps, Hope your all good and fighting the good fight.
I have a question regarding Natwest, I have followed your advice and sent my 3 letters(trademark my name).
Yesterday i received a letter from them stating,
"your letter has been sent to our legal department; however, they are bemused by your demands that we provide validation of the debt and verification of claim. These requirements form no part of UK consumer credit law. They are contained in the United states of America legislation- The fair debt collection practices act but us law have no bearing on your credit agreement with us"
They go on to say "they do not consider it necessary to meet my request and i should repay the sum owing....
What should i do...Is this the usual bull they send out?
Where do i stand with regards US and UK law?
Where is this going to lead me..???
am i going to end up in court and forced to pay money i don't have?

Any advice would be truly welcome....

Im trying to hold my nerve but its getting scary now...

This is just the std bollocks they send out to put doubt in your mind, bill them as thay have not given you what you requested
bare in mind if the debt exists then they should be able to produce the relevant documents to prove it ;)

Billing them is certainly an option but don't be afraid of their letters which are purposely constructed to confuse and intimidate the likes of you and me.
I've been at this for over three years and I believe there's nothing I've not seen before. I now respond according to how I feel at the time and often I challenge them to take me to court on the basis that if they do so they will be required to open their books and explain where the money came from that they allegedly lent me!
In my opinion you've got to read between the lines and understand the terminology as most of the time they're just standard responses and nothing at all to worry about.
If it helps to reassure you I have also dealt with NatWest on an overdraft and a large credit card account.

Thanks for your post....
If you don't mind me asking, what was your outcome with Natwest. I'm in the process of dealing with Natwest with Credit card bill and a overdraft. They have ask me for a reply, I don't really know how to respond, Im new to this and don't know what my next set is. I will bill them, but i feel i should as them questions about my account. But im afraid i don't know the correct terminology to use.....
Many thanks
