Barc/Merc/Cald need to reply to all?

Postby contacteric » Wed May 16, 2012 9:50 pm

RE Barclays, Mercers, Calder Financial and Power2contact

Is it necessary to deal with all of the above with the 3 letter process if they get involved?
Or is there some simpler way?
Especially with Mercers who, when challenged, make no claim to be anyone other than Barclays.
Also with mercers, given the status of the company, what can they do and what can we do to them?
My signed for postage expenses are about at my limit!
Any thoughts appreciated.

Also can anything be done about Power2conect's threat; 'If you do not respond to this letter we will assign one of our Contact Managers to make a personal visit to your home to collect payment,'
Surely that is tantamount to 'sending the boys around'! Surely harassment?

You're right - Mercers are dormant and can't do anything as a non-trading company. It's just Barclays playing tricks on people. But - just to give you a bit of insight from my experiences to date, I have used the 3-Letter (TM) + Estoppel on Barclaycard and Mercers (and also Resolvecall, who gave up very quickly).

I sent the 'Notice - Removal of Implied Right of Access' very early on (with Letter 1), as Resolvecall sent someone to my door. They got billed £5k for common law trespass the 2nd time and that seemed to stop them.

I've received a letter from Calder Financial but they are not a legal entity (they are merely a trading name of Mercers aka Barclays), so I'm not going to bother with the letters to Calder. I will just bill Mercers for another breach of TM/Copyright and wasting my time.

If you haven't already done so, make sure you send the 'Notice - Removal of Implied Right of Access' to Powertoconnect, with whatever letter is due to be sent to them next.

It's worth sticking with the process because it works.

If the power2 guy turns up ,he will phone barclays and give the phone to u ,that is all that will happen, how you deal with barclays on the phone is up to u ,but at least you then have power 2 visit out of the way :D
