Hi I am new to the forum, but have been having problems with Lowell portfolio/red collections regarding an old hsbc account and OD, Have sent prove it letter after a couple of months they have sent some old dupicate statements and are asking for payment, does this prove it?, the statements also have a number of charges that were added for returned items etc., are these allowed to be added to the sum in question or could they be disputed.
Futher to reading your letters 1/2/3, having stated the ball rolling with a prove it letter would i be able to just send letter 2, or start again with letter one.
The response that I had from lowlife stated that they did not have to provide an agreement just statements these only have a name on them and account no. but not address or the normal details in the top right hand corner account balance/od limit etc., the final statement was ZERO account transfered. (lowlife added that this ZERO balance was due to the account being sold to them but they had no details and had to wait weeks for the statements to be sent) polo126

start the process with letter 1, you may also get hamptons solicitor right to you just an inhouse dimwit pretending to be a solicitor, deal with them the same if they do.

Hi Ceylon I have had metro first followed by lowells then red with the treat of Hamptons thats why i sent the prove it letter, thanks for the advise i will send off the first letter as a reply to their sending me old statements and see what happens. polo126

Hi Ceylon I have the next letter ready to send i take it that the 10 days includes weekends.

Have had a further two pager from lowlife's going on about exerting a contract right to pursue payment, and they gave notice of assignment with there letter, no contract between me and lowlife and the agreement between me and hsbc makes me liable, they have no obligation to provide accounting, a sworn affidavit or hand signed invoice and would not issue a specific deed of assignment unless court action was taken.
They also state that they are under no obligation to supply a copy of the agreement for this account, it is a regulated agreement and under section 74(b) of the consumer credit act 1974 whereby any requirement is exempt for current bank accounts and they have sent statements which are the only documents they are legally obligated to send, plus further guff on how they are responsible etc., will post more details if required.

Hi Guys Just a quick update that all three letters away, but its been deathly silent from lowlife since reply from the first letter i take it the 30 days starts from the date on the third letter. :)
