Lowell Portfolio and Shop Driect

Hey im after i bit of reassurance that Lowell are just trying to back me into a corner, im a little worried, the day before sending the second letter i received a responses from them stating:

“We would advise you that Lowell Portfolio 1 Ltd, through its collections agent Lowell Financial Ltd, is exerting a contractual right to pursue payment of the above debts following their purchase from Shop Direct by Lowell Portfolio 1 Ltd, Notice of the assignment of the above debt has been sent to you under separate cover in accordance with Section 136 of the Law of Property Act 1925. This is sufficient evidence to make the sale of debts effective”. I don’t know what this means i don’t think they sent me “Notice of the Assignment” Is this legal jargon? I am going to do some research although I have no legal training.


They then go on to state that there is no contract between Lowell and myself, the agreement that effectively makes me liable for the debt is between me and Shop Direct.
That they are under no obligation to provide:
Full accounting of these accounts
A sworn affidavit or hand signed invoice.
Not normally issue a specific Deed of Assignment unless the matter had progressed to court action.

They have “raised a query with Shop Direct requesting copies of statements and agreements” and that this “this will fulfil our requirement to provide information relating to the debts, there is no legal obligation that states we must send the information within a certain time period” Does this mean there are just stalling to drag this out?
They state that all of their procedures in pursuit of this debt comply with the regulations and codes of practice laid down for the industry within which they operate their business.
Because they are the legal owners of the account they have a duty to ensure my credit file is accurate and up to date in accordance with the Data Protection Act.
As the account entered into default with Shop Direct it would be recorded on my credit file and that they are unable to remove details of defaults. Is this true?
I sent letter 2 (five days ago) and haven’t heard anything back as yet.

All is well.

I have been at this process for a while with Lowell for an alleged shop direct debt. Keep to the proccess there reply letters will start to entertain you, i promise. I just invoiced them for 55k in overdue fees etc.

Its great fun, just stay with it!

Seems to me that Lowell are starting to panic and will use everything they can think of to frighten and intimidate you into paying up.
I am sure that Lowell have many other people doing the same as you are doing and Lowell are running scared. Maybe they should get out of the debt collection business if they cannot take the heat now being fired at them. Just keep doing what you are doing. Keep the faith, look at the posts in which Lowell feature and take heart that you are not alone.
