Idem Servicing Advice Please

Postby scwgneil720519 » Fri Jun 01, 2012 1:18 am

Hi all,

I have sent letters No 1 and No 2 to these people so far, I have received two responses from them. The first was to say that they would deal with my queries within 8 weeks.
I proceeded to send No 2 on the 15th day after No 1 and they have sent their second reply which I have attached.
I am not quite sure what the best thing to do with letter No 3 would be...I have modified the template to suit my details and schedule of fees etc. But I would like to know if it is a good idea to respond in substance to their letter (so as to avoid dishonour and to rebut each of their claims) or do I just send my modified template?

Grateful for any ideas, thanks?

Neil

Thank you. It has been a bit longer than the original 14 days I gave because I work away from home. Is this likely to affect the outcome in any way?

Just send letter 3 as its content, do not get into a rebuttal of wording from their template responses, (you can be walking on rocky ground later on), once they have received signed for letter 3, any correspondence Bill Them, unless of course they produce a signed Bill of Exchange :!: :!: :!:

I have sent letter No 3 and I think I can safely say it has been recieved because my partner received a call from Arden Credit Management earlier today asking to speak with me. (I am away working again).
I realise now that I sent a slightly earlier saved version of No 3...do I send No 4 (Notice of Estoppel) now or do I start billing as per my fee schedule?

And Estoppell after a clear 30 days of non contact from them.

A question with respect to billing...because my partner has answered at least two calls from Arden in as many days. Do I charge £5000 (£5000 being the figure I have set) for just one instance of their failure to uphold their side of the agreement? Or do I charge £5000 every time they attempt to make contact? plus any "extras" like phone calls, letters etc. Which I charge at £100 per item, prepaid and £1000 per item not prepaid.

And does anyone know a name of someone I can address and send the bill to?
