Blair,Oliver & Scott or Bank of Scotland

Postby otakar » Thu Jun 21, 2012 4:58 pm

I received a letter telling me I would be dealing with Blair,Oliver & Scott in connection to Bank of Scotland credit card.
So believing that i was dealing with debt collectors i got as far as sending all 3 documents 10 days apart.

The last being sent 18th June 2012. today i received documents from Bank of Scotland, also based in Fife though not identical address to Blair,Oliver & Scott in Fife. these documents dated 19th June 2012. in short the letter refers to CCA sect 78 of the CCA act 1974. enclosed is also copy of my signed aggreement for credit card (which to my understanding is a legal fiction).

My point is should i have started the three letters to Bank of Scotland, even though i was under impression of Blair,Oliver & Scott. also is it too late for them as I they have already received and acknowledged receipt of my three documents before sending above.

finally should i start the 3 document process with Bank of Scotland since they seem to have come out of hiding, or am i in the clear? and need only send them an invoice, 30 days from third letter?

Its all very worrying and exciting at the same time.

Thanks for any advice.

Up to you either send the 3 letters (bank) or leave it and see what happens
You don’t have to wait 30 days to bill them only if they contact you after letter 3 then you bill them
30 days of no contact then you can send the estoppel
Hope that clarifies the situation

Excellent thanks for prompt reply. I'll sit it out and see if they contact me again.
I'm trying to find reference to something i read earlier, is there more content that can be added to the 3 letters to reinforce there stance?

others have referred to ceylon's contribution but I'm not sure what that is.

I have 2 more cards to deal with, I started process with BOS and BOS as they had started the debt collector process, so being new to this I wanted to see how it went, before proceeding with others.

cant wait to get this all behind me.

Thanks again

what we probably happen is the debt collector will give it back and BOS will pass it on again and you may need to do it again and if any contact you after letter 3 that’s when you bill them
There are other bits you can add but as you’re new just get used to what you’re doing first or it can get confusing

Okay straight forward then.

I have a developing understanding of what my rights are, it really helps to get feedback, as time consuming as us newbies are. Thank you.
