DVLA want to prosecute for not paying road tax

The DVLA Enforcement Unit has impounded my car for not paying road tax. I have not paid any 'monies' to recover the car from the police and I have not filled in a vehicle disclaimer form either.

They sent a letter demanding I pay a charge to avoid court action for non payment of road tax. I sent a notice of non acceptance of their offer and requested clarification as to whether they were referring to a person (legal fiction) or a human living soul. I gave them 7 days to reply and that they if they did not respond to all points of my letter in substance and in good faith then it would be deemed by all parties to mean that "you and your principal or other parties abandon all demands upon me."

They have responded with a letter using a legal fiction name in title case but on the envelope they had hand written the name I am commonly known as. They also stated, "After careful consideration, it has been decided that this case should be settled by prosecution and the case is now being prepared for court. You will receive a summons in due course. With regards to the Late Licensing Penalty, if not settled will be passed to one of DVLA's Debt Collection Agencies to recover the outstanding debt."

Any ideas how I can deal with this? :idea:

I think its too much of a grey area for people to comment on this at the moment due to lack of knowledge and no real successes with DVLA in my opinion.

It would seem that they are on a bit of a crackdown at the moment.

A mate of mine got in a similar position yesterday when a DVLA van with ANPR cameras on the roof came around and clamped him outside his house.

Have spoken to a number of people who have allegedly had some success, but most seem to have done so by removing the clamp, which is not a route we want to go down (at least, at present). Apparently there have been administrative successes too and am trying to get in touch with those who have had them to extract the details.

Spoke with their local extortion-agents yesterday, who have agreed not to impound the car until Friday, so we are aiming to get something done administratively before then. Assuming we do, will update then.

This sounds potentially fraudulent for me - I'd be tempted to send it back and ask them WHICH individual it was intended for as they have created confusion by their inconsistency!

The DVLA have passed this matter onto a debt collection agency who wrote to a legal fiction. I sent them a letter asking them to prove their agency and they have not done this so far. Because they did not respond, I sent another similar letter. I shall see what happens.

well it wasn't an imaginary legal fiction using a car
it was you
so you are responsible for paying tax and insurance

Getting out of debt free is one thing
but never having the intention of paying to begin with, thats different
pay up you freeloading pikey moocher

I hope they crush the car
and lock you up for 30 days

Police cars are insured through corporate liability insurance. Not like private cars. This is because they are classed as pool vehicles, to be driven by anyone authorised to do so.

If they have an accident, it’s the corporation who pays, through their liability insurance. ;)
