update =Its been over 30 days now no response from barclaycard so sent estoppel. Also received letter from MKDP (chasing £9k) after debt letter 1 sent their reply states:-
We do not recognise any contract with you as per the agreement that you refer to in your letter. The account detailed above was purchased from Barclaycard on 22/6/12 which means that from this date MKDP LLP were the legal owners of this debt.
Your request for verification and a hand signed invoice in accordance with the bills of exchange act 1882 is based on the misconception that Compello has provided you with a bill of exchange, this is not the case.the bill of exchange act1882 provides the following definition of a bill of exchange in section 3(1):a bill of exchange is an unconditional order in writing addressed by one person to another, signed by the person giving it ,requiring the person to whom it is addressed to pay on demand or at a fixed determinable future time a sum certain on money to or to the order of a specified person,or to bearer.
Barclaycard entered into a credit agreement with you by which they agreed to provide you with credit with a limit that they may determine from time to time.As required by law the credit agreement states that it is regulated by CC act 1974.
The credit agreement does not meet the definition of a bill of exhange. It is not an unconditional order, it is a contract stating the mutual rights and obligations of the parties. The existence of those mutual rights and obligations by themselves demonstrate the agreement is niether unconditional nor an order..
Copies of all relevant paperworkwill be requested from BC and forwarded to you as soon as we receive this. At such time we will expect our verified claim to be paid in full a stated in your letter.

Iv sent debt lettr 2

Mkdp have purchased the 9k debt from barclaycard on 22/06/12. I noticed from other posts that most were bought on the same day. So they must bulk buy the lot obviously at a minimal fee.
