common law copywrite notice

Postby fido69r » Mon May 07, 2012 2:44 pm

Hi, I'm wondering if someone with time could possibly help
Albeit I'm new to this site, I have spent practicaly all weekend on it, trawling through the forums, videos and tutorials, ebook etc. I have found most of the answers and have gained a great deal of knowlege in doing so.
I have read about a guy who lost his house,car, wife, and possibly his cat, by using the standard 3 letter option, which was taken to court and ignored by the judge.
I had decided to take that easy route, however upon reading that, decided on the copywrite option, which may indeed have more teeth.
This subject has indeed been touched on many many times in the forum, and not due to my lack of understanding, but through possibly confusing input from some of the forum donors, has caused my brain to malfunction slightly, when trying to understand what was initialy straightforward when viewing the tutorials.
I'm hoping that someone here can please answer the following questions I have, clearly and concisely, as I'm sure it will really help others that are equaly confused on the same points. perhaps a sample picture of said page could be posted in the tutorials one day.

In relation to the common law copywrite Notice signatory page. (last page)

1. Are there any errors that one can make on this page that would render your copywrite worthless or invalid?
2.The autograph & seal by:signature...Does my signature have to run through my thumbprint or just thumbprint next to it?
3. Are the witnesses thumbprints compulsary or would it invalidate the document if they wernt present?
4. The copywrite stamp template- This is printed over a postage stamp or thumbprint in the bottom right of this page, after the
witness signatures..is that correct?
5. Does the postage stamp or thumbprint have to be signed on in any way before the copywrite template is printed over it?
6. Does the TM logo have to be in blue as seen in the template, or can it be black?
7. when sending copywrite notice, the last page containing signatures & seals will be a photocopy of your original?
8. Does your seal also have to (compulsary) go on any of the open letters that you send, or on the estoppel letter or on the bill?
9. If so, is that seal to be the same one as on the original copywrite notice on the bottom of the page, complete with postage
stamp and copywrite/TM template printed over the top?
10. Can you just use a postage stamp OR just a thumbprint for your seal...or use both together?

Thank you in advance..I have tried to make it as short as possible, but please can you clarify any answers the best you can, so that errors are avoided.

this is wahat I do some examples=
1= if follow process will be ok
2=signature then thumbprint over it so no one can lift signature/its your seal,you seal it
3=as 2
4=over postage stamp, lots of members also seal it with thumbprint bottom right and reverse bottom right
5=copyright template over stamp / then sign diagonly across stamp as in video / then seal with thumprint.
6=no and yes black
7=no send a copy with no signatures/seals
8=up to you, better fully loaded its your seal/copyright etc
9=as 4
10=either

hope this helps , i'm sure better placed members will let you know if anything to add. some dont use copyright template stamp and just use thumprint but put tm or/and c within a circle .
i do as video and put a stamp top right of page sign diagonly across it , under stamp i put with the autograph and a c in circle on the left of stamp or at the top. also on bottom right with or without the template stamp , as in video i sign diagonly acrosss stamp and put to the left of stamp copy-claim and above i right seal.there are many correct ways to do it not just one way ,up to you which choose i use dave-sydney method.

HI

I am new to this too!

When this copyright document is completed, and published online etc!

Do you then send 'Copies' of the original to people and companies and keep the original in a safe place?

***Update!***

I have had a quick word with a legal intellectual property barrister I know and he seems to believe you cannot copyright your name, but you can register it as a trademark ® as many celebrities do which works in regular law and would work in Court.

However unregistered trademarks such as ™ mean nothing for a persons name, only a product or trading name if you can prove long term use of a unique name.

If someone registers that product name at a later date you and you can prove continued use, then and only then will the intellectual property office uphold a complaint and transfer the name, after regular court action which would costs literally thousands.

So simple and cheapest action here would be to register your name as a registered trademark at the IPO which costs about £200 + £50 per different category, but even then, if the name was being used to identify you, then someone could still use it in emails, court papers under fair use laws.

Under common law, no Judge would take a ™ seriously for a name.

Nice idea though!

If anyone knows anything different or any precedents for common law here in the UK I would love to hear from you!

I think..and i'm open to correction on this, that the original is kept in a safe place, and you send copies of the originaly dated copywrite notice minus the signed/sealed last page. (which would be blank, as in no signatures, but dated same as original copywrite dated document.) The date on page 1 of the notice, from what I understand should be your birthdate when you were 18 yrs old. (the original Document is only produced in the unlikely event the the matter goes to court)
Also...you only publish a declaration online...not the document itself.

Hope that's right.
