My MBNA

Hello all,
I have sent letter 1, and sending letter 2 today.
MBNA responded with a letter saying Bills of Ex 1882 is for negotiable instruments such as promissory notes, and not relevant to them as their agreements are regulated by the CCA 1974, and if I'm having difficulties they would like to help me (of course they would - they could help by zeroing the balance and forgetting my existence.)

They have then signed it ' MBNA EBL' in a fancy font, which I find strange as all other letters are signed with a name that would leave you feeling it came from a human.

Is their evidence on this site that this approach works to get rid of these vermin, or are we just keeping the postal service afloat? If I end up billing them after all letters are sent and follow up by pursuing what they owe me, will I win in court?

the idea is to have a counter claim so they will be to scared to take it to court as if they lose they will have to pay you. they stop eventually.

Well...sent letter 2 and 3 with the same responses as others on this site. Also started this with HFC. When I got a phone call from HFC demanding monies and quizzing me, it felt great to take control of the conversation. I simply felt empowered, and the person on the other end was getting p155ed off.

yes never answer there "security questions" and there done for all ways ask questions.
can you confirm your name please, sure hwho is this?
bob brown what is your name, what do you want?
i need to talk to peter smith is that you, i dont give personal information over the phone what is it to do with? (they can not answer this as it would be a breech of data protection. they usually get upset as without your name there is nothing they can do.

have a listen and see how confused they get

All 3 letters to MBNA, checked they were delivered. Sent them their 1st Bill.
So much info about signing on bills, and seals and stuff.
Done my best tho.

Are there any sample bills what others have written on here, as I'd like to avoid any pitfalls?

Also, HFC have had their 3rd letter.

Searched for sample Bill in Gen Topics, couldn't find it. Looked at BofEx Act1882 for a little guidance.
Anyway....
MBNA have ignored my first Bill, and then sent letter stating they are getting a DCA to recover the 'debt' on their behalf. More fun to be had!
Sent MBNA a new Bill, and have drafted a Notice of Dishonour which must be with them a day or two after dishonour, according to BofEx act1882.

Can't wait for the DCA to come at me, cos I'm gonna take it all the way...letters, bills, polite reminders, notices, then Court.

Who writes these 'ACTS', so long winded....been at it since 8 this morning.

Wow, got letter from DCA following day, after MBNA said they were using a DCA. Was dated 3 Oct 11, but received on Sat 8 Oct.
Already got the 3 letters drafted up to be sent starting Monday the 10th.

date the first 5th oct then you only have to wait 5 days to send the second like they did with you dated 3rd arrived 8th use the same tricks they have used
