hello ceylon - do you think this guy dave murphy has the right approach? i am experimenting and have used this approach as well as the guy euden & winston shrout approaches - i seem to have had some limited success with the later but i am not sure about dave's method - am currently in dispute with SSE over my electricity - they are now threatening to come with a court warrant to install a pay as you go meter - i have withdrawn the implied right of access from my property & have a notice to that effect at the bottom of my drive - the two 'visitors' i have had so far have complied with this notice but they have not yet come bearing warrant as far as i know - if they do come bearing a warrant - thinking that this empowers them - gives them authority - & they actually do get to my front door & try to harass my disabled partner when i'm out what is your best advice? - i'm telling her to give them a copy of the notice and a fee schedule for ignoring my notice which carries a penalty - is there anything else she can do other than not answer the door - i am about to write to them informing them that the implied right of access is withdrawn but i am not sure whether this will be effective - any advice will be much appreciated as ever - is there a way of using copyright notice with them in a similar way to that of the banks ( i am about to send letter 3 with copyright notice to co-op bank) - cheers! jonny

what have you done so far?
i would send a covering letter and prom note then i could say i gave them every opertunity to reject my payment but they agreed as they never returned the prom note or BGC then you would have a strong case to have it struck out when they attempt to get a warrant of entry, they have to give you notice that they are going to try and get a warrant

Hi Jonny
With Ceylon's support i have already started this process and i recommend you follow the instruction suggested by him. I will give you feedback on my thread here:

http://www.getoutofdebtfree.org/forum/v ... 68&t=34372

and i will support you any way i can but stick to Ceylon's advice. Also chech ceylon's youtube page "ceylonx" for more videos and his interviews with "Ben Lowrey Himself" on youtube, very useful. Remember to have the digital camera ready. PM me any time.

If signing and sending back the Giro Credit slip is payment, why do we have to send a promissory note as well? Is it just an extra precaution?

ah, so this probably works better than just sending back the BGC as Dave suggests.

Can I ask if there are any templates available for a promissory note? I got one from Veronica Chapman but it mentions Strawman, so we have to say "I Miss...." which is then giving them legal standing isn't it? It also requires it to be signed by a member of the notary public so it'd be great to be able to see a sample.

Good luck Dee with your process. I will support you any way i can.

I have a feeling that the companies involved do check the forums for updates. I got a reply the day after posting the Notice and prom note and i had sent a 2nd class letter recorded. I think i better trace the letter to see when it was signed for.
And if you are reading this British Gas, please don't waste anymore money sending me letters because i have already paid you PAID YOU DOUBLE.

I don't suppose it matters if these companies ARE starting to catch on and check these forums. They can't get out of it just because they know what we're doing. What we're doing is perfectly lawful and what they're doing is not! Ceylon said before that if they refuse to accept our promissory notes then the debt doesn't exist so either way they can't win. We probably need a bit more in depth information on what to do when they send back the promissory notes anyway. Although, if they've accepted the BGC then surely that means they've accepted payment anyway.
