Due to my mental health problems I have found myself (regretably) in a lot of debt. I have tried every which way I could to deal with it all to no avail, I began to read about my Strawman and found eventually this forum, I have 3 credit cards (£9-£12k each) and that is the only debt.

All are referred to DCA, but I have to confess I am terrified. I am being bullied quite badly by these people, and as I am a homeowner I am really really living in fear they will put a charging order on my home.

I have sat down today and done letter 1 to all the debt collection agencies and original credit card companies. I know its hard to say and I have to steel myself for a fight, but can anyone put my mind at rest, will this work?

I am in a shocking state with it all, my psychiatrist is desperate for me to be able to sort all this out as he says its having a radical impact on my chances of improvement.

it works as long as you do it as sugested, are you moving soon? if not and if they manage to get a order so what, we only have to get past the next year or so and everything will be sorted out maybe even sooner.

read as much as you can in the forum and go on the home page and watch as many videos as you can this will let you see whats really going on.

There's alway assistance here with many beating these bullies at there own game, as posts will show once you get started hopefully the fear will go :D

Thanks for your replies, no I am not planning on moving. Infact my home is about all I have left thanks to this damned illness. Would you mind telling me more on the charging order situation? It was my understanding that if they couldnt provide lawful evidence (which they cant) then they cant pursue me via courts/charging orders, is this not the case? Also, lets say for example this did happen, can they force me to sell my house??

I am trying to be strong on this one, but its taking it out of me, I feel confident in what I am doing but because I am vulnerable I have to be doubly ready to be bullied.

Hi Laffey123

You did the right thing by coming here, you are doing something positive about the debt. By reading through the forums and arming yourself with knowledge you will be able to deal with anything they throw at you. Legally, they can't prove that you owe them the money as you created the money yourself, that is the first weight off your shoulders. Dealing with these kinds of problems is more difficult when you have mental health issues, i understand how you feel about this as i have experience of such issues myself.
This debt issue will be sorted out in your favour and in the very near future there will be no need to worry. PM me if you need any extra support. Look at the case histories in the forum and you will be amazed at the success stories.

Thank you so much for your reply, very encouraging. I got another nasty bully letter this morning from one of the DCA, addressed to 'Dear Sir/Madam'!! Asking for my salary details, despite me telling them I only receive benefits!! Well, letter 1 will hit them all today so I shall have to take it a step at a time and try to remain strong.

You are welcome. :D

As you will become aware their letters are designed to cause fear, they do this method because they get away with it. The letters are not legally binding-do not give them anything-do not fall into the trap of giving them "Joinder"

definition, JOINDER:

n. 1. The act of joining. 2. Law. a. A joining of causes of action or defense in a suit. b. A joining of parties in a suit. c. Formal acceptance of an issue offered.

Basically, they are trying to force you to accept their offer.

Now that you have sent off Letter 1 the power starts to return to you and the fear starts to recede. Take note of what the experienced members tell you and be careful to eradicate any errors, go through your letters with a fine tooth comb.

Thank you once again for your replies.

Before I found your website, and at the height of their intimidation tactics, I did write to the DCA's and explain that I suffer with mental health problems and that I am only in receipt of state benefits (not what type of benefit or figures I receive) I also offered each of them 10% of the total of each of the 3 debts to settle in full and final payment. All have continued in their harrassment, totally disregarding my offer (which was going to be given to me by my Father).

So, whilst I have probably done wrong by doing that, I hadnt found this website and I was literally terrified of losing my home, I now see things in a different light thanks to the very kind and learned people here.

I see the error of my ways, but I am sure that many vulnerable people before me have fallen, it can be very intimidating to be threatened in this manner.
