Hello,
I'm hoping someone can point me in the right direction with my situation. I realise after reading some of the advice on here that I may have gone about dealing with the problem the wrong way and am hoping i still have options.
Lowell sent me a letter at the end of last year telling me that i owed money from an old account, so i rang them as i had no idea what they were talking about, they `kindly' offered me a goodwill discount if i paid there and then, which i turned down as i wanted proof of this debt which they claimed was from 2006. So about a month went past and i had another letter through the post with my `proof', which was a load of copies of what can be called a statement i suppose that they had ordered from 2001 but without my details apart from the account number and showed an amount totally different from what they were asking. The letter stated that they had contacted the bank who have confirmed that the difference in balance arises because the statements provided only show the balance as at the time it was closed on their system. Any payments made to the account since this date will not be showing.
So I rang them again telling them that this is not exactly proof, all it shows is that you can access my account and the statement is from 2001!! I spoke to a lady who somehow decided that the debt was now from 2007 (this is in january, how convenient that it would make the debt just five years old again!) So, again I asked for proof of this debt as i was not convinced and said that i'm not refusing to pay if the debt exists, i just want proof that it does.
It then took until march for them to send me a letter telling me that any dispute must go through the complaints department for the bank!!! They gave me 28 days to do this while they put my account on hold.
I did nothing.
They then sent me an email in april telling me three easy ways to clear my debt. I thought that was kind of them.
They also rang my mobile which i answered, it was quiet for 7 seconds and then they rang the house phone, the number of which i hadn't given them and was extremely irritated that they had done this. I spoke to them again, i tried my best to be calm but I'm not altogether sure how i faired on that, but after some time and annoyance about how i just want proof of this debt and an old statement that shows a totally different amount is not proof and surely that just makes it statute barred on account of it being so old and how did you get the statement in the first place and how did you get my home phone number and why do i have to do all the running around to prove a debt that they have no proof of....etc etc I have now left it at them telling me the only way to resolve this is to get in touch with the bank. I told them fine, give me 28 days and we'll see where we stand then.
Again, I have done nothing.
I have now had a new letter with the same amount owing but that the period it covers is from 2008 to 2012??????? and there is also a new date on this letter which i have no idea about saying Credit agreement dated: 20/02/1989
I never had a credit agreement in 1989......what is this all about???????
Where do I go from here.....it's just getting ridiculous.

Just start with the 3 letters on here and that should give them some direction as to what you're doing,

Just one question, should i be signing these letters? I'm worried that if they're that way inclined, they may copy my signature and paste it on to some document or other to use against me..... :?

If you do a search on here you find how to sign, or if you sign your name a bit different and put a couple of lines through then it can't be lifted or altered ;)

I hate to keep bothering people on this site but I am extremely worried as after sending Andrew my first Bill I received this letter:

"The letter we have received from you appears to be a forum based template readily available on internet websites, and does not appear to contain any new information that has not already been fully addressed and explained.

we can no longer freeze your account and intend to pursue the balance with immediate effect. as such we cannot hold and phone calls or letters with regard to this account and ultimately this account could be passed to our litigation team who could consider appropriate legal action."

I just wanted to know if anyone else has ever received this letter and what's the next best move to take, I am incredibly grateful for all the help and support given on this site

I would bill him again and add new charges as set out in 3rd letter
or you can ignore it and wait for next response from them but billing them means your not going to roll over for them in my opinion
