Hi Ceylon,

I’ve now received Form TE3, ‘Order for recovery of unpaid penalty charge’ from the council for both PCNs/Charge Certificates. Form TE9 is enclosed with TE3 which appears to pre-empt the course of action to inform the TEC that I did not receive the Notice To Owner, as this is one of the options on the form (the other three options are:- I made representation, I appealed, The PCN has been paid), with a statement below the options stating ‘Proceedings for contempt of court may be bought against you if you make or cause to be made a false statement in application verified by a statement if truth without an honest belief in its truth’.

So, I’m not sure what to do. Do I write a letter to the TEC saying I didn't receive the NTO otherwise do you know what I should do next, or do you have any other ideas or suggestions about what to? Thanks.

they mean you opened it read it but if you just binned it you never got it plus remember its not a real court

Thanks again, I do understand NBCC is a bulk clearing centre and not a real court, so I’ll just wait to hear from them first and then write to them to tell them I didn’t receive the NTO?

Hi Ceylon,

I didn’t receive anything from NBCC after getting Form T3 from the council but it states at the bottom of Form T3 that it was drawn on the authority of TEC, NBCC.

Instead I’ve just received a ‘Warrant of Execution – unpaid penalty charge’ for both PCNs from the Governing Bailiff, which has ‘To the certificated bailiff’ written in the warrant and giving them the authority to issue this warrant to recover the unpaid penalty charge

Is there a way of finding this if they really are certificated or not and can I/should I still send them a Notice - Removal Of Implied Right Of Access?

put up and send denial. this is how to check if they are or not but you need the name, you can also check the company

is it signed and can you make out who it is?

I have no been given a copy of the warrant. despite asking for it?
However the bailiff they are using is listed on the above list!!
