Bailiffs at workplace

Postby ukahmet87 » Tue May 29, 2012 11:23 am

Hey guys,

We got a visit from a bailiff to our work place yesterday for an electricity bill that was run up by previous tenants, whom fled the place without any notice, thus bills remained unpaid. But at the same time the billing was on my bosses name at the time (because he rented the other side of the property to them), however the name is spelt INCORRECTLY. For example instead of John Smith, its JO HN SMITH (Theres a space in the first name, making up a middle name for him i guess? lol). I showed them our notice of removal of implied access, had a bit of fun with him, and he said hes going to have to return and do forced entry. Before he left he popped a petter in the post box stating he may need to call dog handlers and police if requested for the forced removal etc. Now, my question is, what is the route i should take?

1) The name is incorrect, thus we could tell them that fictional entity doesnt exist; adressee not recognised.

2) Send them a notice of removed implied rights of access, and letter 1, however does this not mean we give them the correct spelling of his name? Will they be able to pursue by changing his name?

Id appreciate any help at this point as im not sure which route to take.

Oh, i also recorded the event from yesterday, its quite funny how the bailiff got off the property to try call police, WHO NEVER TURNED UP. ill post it to youtube when i can.

Its for £1600 EDF Energy. Well when i went there in the morning he was inside the garage (he was ON the property), however, when i asked the employees if anybody had given him permission to come in, they said no, which is when i prompted him to read the notice at the front of the gates otherwise he would be commiting an offence. He read it, and i stated to him that hes now read the notice, and is still on our property... he then reluctantly decided to move off the property and said "im now off your property" (this is recorded on camera)... in which he then calls the police, who didnt attend!. i then tell him further that he has no access to our property, and said that im now assuming he accepts my notice as he was ignoring me (i confirmed this about 3 times, and everytime he remained silent on all counts, imo accepting the notice... he then sat in his car, we all went back in, and then he got out and posted a letter in the post box, which ive attached below... no paperwork etc was ever signed...

Ive prepared a notice of removal of implied rights, however ive done it slightly different. ive written it under my own sovereign name (not my bosses, as that would giving away the correct spelling of his name to the bailiffs), and have stated that the addressee is not recognised, and put underneath that im the authorised agent and represantative for the property of 31 first avenue etc etc.... i havnt sent it yet as im not sure what route to take now... however, my main aim is to simply not allow these sort of people on our premises, as the person theyre looking for is a non existing fictional entity (wrong name)

Ive posted the notice of removal of implied access to them yesterday 1st class recorded. Ive also received a letter this morning from them (again, name is addressed incorrectly). Ive attached the letter, theyre stating theyre coming with removal contractors... how should i proceed next in your opinion?

Then the chances are the paper work they have is in the wrong name and as such unenforceable
