Hello, can someone lease advise urgently on the attached letter I received today. These guys (Allay Claims) ‘helped’ me to claim back some banking charges and are now demanding for 35% of what was awarded! Is there a template letter I can use to reply to this letter? They are now threatening me with county court action and use of bailiffs etc. What do I do now? Assistance much appreciated! Thanks in advance you lovely bunch.
Did you sign a contract with them to pay 35% ?
Hi Tiggy, they sent me a lengthy document at the time which might have been a contract that I signed but it was so lengthy I didn’t read the fine print to check how much commission they would charge and I didn’t even understand it anyway but I signed it. What do I do now as it was a while ago and I can’t afford to cough out the fee they are demanding – thank you
On the presumption they have the original you signed, all they have to do is produce that contract in Court, they don’t need any other proof of debt.
How much did you think you were being charged ?? Did you get any money refunded to you?
I was charged a little over £292 (the letter is attached to this post) however I didn’t receive the demand from Allay Claims weeks after the bank credited my account with the refund. In the first instance, I didn’t know how much they would refund so when the bank credited my account I just assumed Allay Claims had received some commission directly from the bank as they filed the claim on my behalf. Anyway, I had already spent the refund before I received the letter from Allay Claims several weeks later. Do you believe it’s actually worth their while to take me to court over £292? Will it not cost them a considerable amount to do so? Can you advise on any get out clauses?
Any Court costs will be passed onto you if you lose the claim. You can ask for a copy of the contract and see if there are any unfair terms.
Also, check the Ministry of Justice claims management registration web site to make sure they are regulated.
Thanks for the reply – if the matter goes to court and I agree to pay immediately without attempting to defend it, will I incur any further costs?
