A few things to remember about DVLA and their futile attempts at prosecuting motorists -

1. FOIA requests in the past have revealed that DVLA do mislay and lose documents sent to them;

2. If they ask for details of your defence, do not tell anything whatsoever. They are not entitled to have any details of your defence and they know this. They just hope you do not;

3. If it does go to court and the DVLA "prosecutor" asks or attempts to speak to you prior to the hearing to "discuss your defence", refuse to do so. The DVLA knows very well their staff should not be doing this. Make sure the court knows what the DVLA "prosecutor" has attempted to do.

Amongst some of the tactics used by these so-called "prosecutors" are -

a. Throwing a hissy fit, having the hearing adjourned and not turning up for the adjourned hearing;
b. Attempting to intimidate defendants into pleading guilty;
c. Telling defendants they are unlikely to be found Not Guilty and to go home.

They will do and say anything to prevent a defendant going into court and blowing DVLA's faux case to smithereens. Do not fall for their manipulative ways or lies.

What these people are doing is illegal and the offence they are committing - Attempting to Pervert the Course of Justice - carries a substantial custodial sentence.

Just updating and letting you all know that the advice given by all on this site was brill DVLA have stopped sending letters I have not had anything for a year now :lol: :lol: :lol: :lol:

I also sent a letter to the DVLA notifying them that the vehicle had been given back to the finance company shortly after that date and the first that I heard of the offence was in August of last year. I then sent a letter once again confirming that the vehicle had been taken back to the finance company and as I hadn't heard anything back from the DVLA had assumed that the matter had been closed.
