I have no idea what I should do or how/if I should respond. Any advice or help from anyone would be great.
So you have a CCJ, who was the claimant? Are you making payments against it, if so to whom?
This is the first thing I’ve heard of a ccj and upon checking my credit report nothing is showing there. No I’m not making any payments.
Lending stream were the claimants.
if no ccj then you don’t pay,so if 100% sure just ignore. They are just a 2 bit firm trying it on.If you do want to reply then ask then for more details ie amount, which court, when awarded etc.If you had a ccj awarded then you would have received a claim form (unless you moved away?). So as said b4 believe this is a try on.
If you’ve no CCJ did you mean Lending Stream were the original creditor?
You might want to check either with the county court business centre or trustonline.co.uk to see if there is a CCJ lodged against you.
Sorry yes lending stream were original creditor. I have moved away so will check to see if a ccj has been awarded. So if I see that no ccj has been awarded your advice would be to just ignore them?
I’ve checked and there’s a ccj registered at an old address. What should I do now?
What’s the date of the CCJ?
You could possibly apply to get it set aside and properly defend against the original claim.
2nd December 2016 actually. Ok how can I do this?
Then you should be able to apply to get it set aside.
How do I do this and wouldn’t It still be held as I never made them aware I was moving?
You apply using Court form N244, it costs £255 or free if on benefits or low income, you will have to explain you have moved house (provide evidence of the date you moved) and that you’ve only just found out about the CCJ but believe you have a good chance of defending against it.
The quicker you do it the more chance you have of getting it set aside.
T M LEGAL SERVICES IS A COMPANY RUN BY A LITHUANIAN, WHO HAS ALREADY DISSOLVED THE COMPANY ONCE FEW YEARS AGO. (have a good google session!) but furthermore, EVEN IF THEY ARE UP AND RUNNING AGAIN, THEY CANNOT, LEGALLY TAKE ANY ACTION AGAINST ANYONE, FOR NOT RECEIVING A RESPONSE FROM YOU IF THEY HAVE ONLY CONTACTED YOU BY SENDING “EMAILS! … ” WE ALL CHANGE OUR EMAIL ADDRESSES FROM TIME TO TIME, AND TM LEGAL SERVICES WILL HAVE NO WAY OF EVER KNOWING, NOR PROVING TO THE COURTS, IF THE THREATENING EMAIL THEY SENT HAS BEEN RECEIVED. TO PROCEED WITH ANY SUCH THREATS, BASED ON HAVING SENT AN “EMAIL” WHICH YOU HAVE NOT RESPONDED TO WOULD BE TANTAMOUNT TO FRAUD, AND CERTAINLY THEY ARE TRYING IT ON.
I FOUND AN EMAIL FROM THEM, IN MY “SPAM FOLDER” WHICH I RARELY EVER LOOK AT, JUST AUTOMATICALLY DELETE, – IT WAS ABSOLUTE PURE CHANCE I FOUND IT, AND THIS WAS ONLY A COUPLE OF MONTHS AGO, TELLING ME, “CATEGORICALLY” THAT “THEY HAD NOW SUCCEEDED IN GAINING A CCJ AGAINST ME”. (THEY HAD NOT). FURTHER, THEY THREATENED THAT “WITHIN 7 DAYS” THEY WERE GOING TO “TAKE OUT” (AS IF THEY COULD!!) AN ATTACHMENT OF EARNINGS ORDER AGAINST ME. IT WAS A VERY THREATENING EMAIL – BUT BASELESS IN LAW! DON’T BE FRIGHTENED BY THESE CHANCERS, THEY CANNOT AND MUST NOT USE “EMAIL” AS A LEGAL AND CORRECT FORM OF SUCH SERIOUS THREATS AND PROCEDURES. I HAVE SINCE CHANGED MY EMAIL ADDRESS. I HAVE NOT RECEIVED A FORMAL LETTER IN THE POST, AND GIVEN THAT THEY WERE GOING TO “WITHIN SEVEN DAYS TAKE OUT AN ATTACHMENT OF EARNINGS AGAINST ME” – SEVERAL MONTHS AGO, AND I HAVE NOW CHANGED MY EMAIL ADDRESS… NOTHING HAS HAPPENED. DON’T BE BULLIED BY FRAUDULENT THREATENING EMAILS. EMAIL CORRESPONDENCE IN SUCH SERIOUS PROCEDURES IS SIMPLY NOT ACCEPTED! CHANGE YOUR EMAIL ADDRESS!
you can contest as Tiggy says depending on your view of success or just wait and see if they pursue the ccj, your choice
When the original poster checked they did have a CCJ lodged against them, maybe you should do the same and either check with the trustonline or the County Court Business Centre to make sure they haven’t got one against you, if they have they can get an attachment of earnings order against you.
NOT BY VERY DODGY EMAIL, THEY CAN’T!
not by very dodgy EMAIL ONLY contact. NO THEY CANNOT.
Yes they can, just as the case of the original poster they can send the Court documents to the last known address and when you don’t respond you can (just as he did) get a judgment by default.
